1. Agreement to These Terms

These terms govern your use of Sifr (also marketed as "MySifr") — the mobile app and website at mysifr.com used to discover non-profit organizations, donate, register for events, manage memberships, volunteer, and receive messages from organizations you follow (the "Service").

The Service is operated by NM Tech Solutions LLC, a North Carolina limited liability company ("we", "us", "our"). By using the Service you agree to these terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What Sifr Is (and Isn't)

Sifr is a technology platform. Masjids, schools, and other non-profit organizations ("Organizations") use it to publish fundraisers, events, memberships, and volunteer opportunities and to accept payments. We are not a charity, we do not solicit donations on our own behalf, and we are not a party to the relationship between you and any Organization.

Each Organization is solely responsible for its listings, how it uses the funds it receives, its event and program delivery, its refund policy, and any statements about the tax deductibility of your gift. We do not verify Organizations' tax-exempt status or vouch for how donations are spent.

3. Your Account

  • You must be at least 13 years old to use the Service, and at least 18 (or have a parent or guardian's permission) to make a payment.
  • Provide accurate information and keep it current. You are responsible for activity under your account and for keeping access to your email and phone (used for one-time sign-in codes) secure.
  • We may suspend or close accounts that violate these terms, are used fraudulently, or put other users or Organizations at risk.

4. Donations and Payments

  • Processing — payments are processed by Stripe and paid to the Organization's own Stripe account. Your payment is also subject to Stripe's terms.
  • Recurring and installment payments — when you set up a recurring donation, membership, or installment plan, you authorize the Organization to charge your payment method on the schedule shown until the plan ends or you cancel it. You can cancel future charges at any time from your account; cancellation does not refund past charges.
  • Optional tips — any tip you add supports the Sifr platform, is not a donation to the Organization, and is not tax-deductible.
  • Refunds — donations are generally final. Refund requests for donations, tickets, and memberships are decided by the Organization; contact it directly. We may assist but cannot guarantee a refund.
  • Receipts and taxes — receipts are provided for your records. You are responsible for determining whether your gift is tax-deductible.

5. Acceptable Use

You agree not to:

  • use the Service for fraud, money laundering, or with a payment method you are not authorized to use;
  • impersonate anyone, or submit false information in forms or registrations;
  • interfere with, scrape, reverse engineer, or attempt to gain unauthorized access to the Service;
  • upload content that is unlawful, infringing, harassing, or harmful.

6. SMS Text Messaging Terms

Organizations on Sifr may send text messages to people who opt in to receive them. Each Organization sends from its own toll-free number, through Sifr, using Twilio as our messaging provider.

  • Opting in — you opt in by checking the SMS consent box on an Organization's form on Sifr, or by texting START to that Organization's number. Your consent applies only to that Organization. Consent is not a condition of any purchase, donation, or service.
  • Message types — donation and payment confirmations, event registration details and reminders, membership and account notifications, and announcements and program updates from the Organization. If you text a donation keyword (for example, "donate50"), you will receive replies needed to complete that donation.
  • Frequency — Message frequency varies by Organization and by your activity.
  • Cost — Message and data rates may apply. Sifr does not charge for text messages; your carrier's rates apply.
  • Opting out — Reply STOP to any message to stop receiving texts from that Organization. You will receive one confirmation and no further messages. Reply START to opt back in.
  • Help — Reply HELP to any message for help, or contact support@mysifr.com.
  • Carriers — carriers are not liable for delayed or undelivered messages.
  • Privacy — we do not sell or share your phone number or SMS consent with third parties for their marketing. See our Privacy Policy.

7. Notifications and Email

We send transactional emails and push notifications (receipts, sign-in codes, reminders) needed to operate the Service. You can manage push notifications in your device settings and notification preferences in your account.

8. Content and Intellectual Property

The Service, including its software and design, belongs to NM Tech Solutions LLC. Organizations own the content they publish and grant us permission to display it. If you submit content (such as form responses or photos), you grant us and the receiving Organization a license to use it to provide the Service.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Service will be uninterrupted or error-free, that prayer times, event details, or other information shown are accurate, or that any Organization will deliver on its listings.

10. Limitation of Liability

To the fullest extent permitted by law, NM Tech Solutions LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of funds, data, or goodwill, arising from your use of the Service or any Organization's acts or omissions. Our total liability for any claim relating to the Service is limited to the greater of the platform tips you paid us in the 12 months before the claim or $100.

11. Indemnification

You agree to indemnify and hold harmless NM Tech Solutions LLC from claims, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Service or your violation of these terms.

12. Governing Law

These terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in North Carolina, and you consent to their jurisdiction.

13. Changes to These Terms

We may update these terms from time to time. We will update the "Last updated" date above and, for material changes, notify you in-app or by email. Continuing to use the Service after a change means you accept the updated terms.
